Duration of the processing

 

The CZSO is not allowed to process your personal data for an arbitrary period of time; the duration of the processing is limited for a period of time, during which we really need your data. We try to reduce the length of the period of time so that it duly takes into consideration your interests as well as ours. Sometimes it is rather difficult to determine the length of the period necessary for the processing or, due to security reasons, it is not advisable to inform about the precise length of the period; therefore, please find below at least some of the criteria according to which we decide about the length of the period for processing of your data.

In accordance with the principle of data minimisation, we always process only such data we necessarily need for the given purpose and store them for the period of time in which they are necessary. When such period is over, personal data are erased, pseudonymised or anonymised.
Personal data are processed as long as we are obliged (or authorised) to store them according to legal regulations in force or as long as we need them to secure mutual rights and obligations arising from a contractual obligation. The CZSO as a public authority mainly follows the regulations governing records management and archiving.

Furthermore, we are authorised to process personal data for the necessary period in case we had to submit evidence in court or administrative proceedings, but always only until the relevant limitation periods stated by law are over.

Personal data we exceptionally process on the basis of your consent are processed for the period for which you granted us your consent or until you withdraw such consent.

The length of the period for which we retain your data may be exceeded, as an exception, when it is justified by circumstances, e.g. if a legal dispute starts or an inspection by inspection authorities takes place, etc.

To determine adequacy of duration of personal data processing, the length of the limitation period, probability that claims will be presented, probability and importance of imminent dangers, and prospective recommendations of supervisory authorities will also be taken into account.
