Decision to refuse a request and the legal remedy - an appeal

 


Providing that a request cannot be complied with, not even partially, the CZSO issues within the term for settlement of a request a decision on refusal of the request or refusal of a part of the request (hereinafter only “decision on refusal of a request”) or, alternatively, postpones the request.

A legal remedy - an appeal - may be made against a decision of the liable entity to refuse a request according to the Rules of Administrative Procedure. The period for an appeal is 15 days from the announcement of the decision.

The term for a decision upon an appeal is 15 working days from the day when an appeal has been delivered to the liable entity. The period cannot be prolonged.

A decision upon an appeal may be further challenged in court by the claimant (by filing an action).
