Provision of confidential statistical data for scientific research purposes - principles and conditions

 


Principles
Principles of confidential statistical data provision by the Czech Statistical Office (hereinafter referred to as "CZSO") to external users are based on the legislation of the European Union and the Czech Republic, especially on the Act No. 89/1995 Sb. ("Sb." stands for the Collection of Laws of the Czech Republic) , on the State Statistical Service, as amended (hereinafter referred to as "the Act"), the Act No. 110/2019 Sb., on personal data processing, and Regulation (EC) No 223/2009 of the European Parliament and of the Council of 11 March 2009 on European statistics.

For scientific research purposes
Although the CZSO collects and processes individual data primarily for statistical purposes, it can – pursuant to the Section 17 “Provision of confidential statistical data” of the Act No. 89/1995, on the State Statistical Service - provide confidential statistical data also for scientific research purposes. Confidential statistical data can be provided only on the basis of a special contract for provision of confidential statistical data. The contract stipulates conditions for the data confidentiality protection and the exact way of data use in accordance with the European Union legislation; it applies to domestic and foreign legal entities the primary mission of which is scientific research. Data is provided in the form not allowing the direct identification of reporting units. For the ordering party and the CZSO the contract is signed by their authorised representatives or persons authorized by them. The research project description and pledge of secrecy signed by all persons who will handle with the data are an integral part of the contract. Data transmission shall be recorded in a written handover report.

Confidential statistical data ordering
Confidential statistical data should be ordered either by on-line completing and submitting of the "Request for access to confidential statistical data for scientific research purposes" or, by sending a completed request form to the e-mail address infoservis@czso.cz or by mail to the CZSO (Czech Statistical Office, Information Services Unit - Headquarters, Na padesátém 81, 100 82 Prague 10).

Based on the completed application form, the CZSO will decide whether the researchers will work with confidential statistical data in the SafeCentre or whether the complete dataset will be transferred via a secure repository.

Price
The price for predefined confidential statistical data files is determined by the Price List of Services and Products published on the CZSO website. In other cases, the final price is set in relation to the time needed for preparation of requested data.


Confidential statistical data provision conditions
 

  • Submission of an order (completed request form);
  • Conclusion of a contract containing necessary annexes: proof of the scientific activity of the ordering party, the research project description and the pledge of secrecy of all persons who will get in touch with provided confidential statistical data;
  • Universities, established under the Act No. 111/1998 Sb., on Universities, as amended, are not obliged by law to prove their main field of activity;
  • Written consent with the limitations which concern dealing with confidential statistical data (obligation to protect confidential data in accordance with the Act No. 89/1995 Sb., as well as with the European legislation; ban on making copies of data; ban on linking databases / files with databases / files from any source, etc.);
  • Without the consent of the CZSO and an additional pledge of secrecy signed, it is prohibited to include other persons, who had not been specified in the contract, even if such a person is related to the same project and is a member of the institution the contract was concluded with;
  • Outputs must not have the character of individual data;
  • On request, the ordering party shall allow the CZSO to view the results and outputs of the research project.
Privacy Policy
The ordering party shall take all necessary legal, administrative, technical and organizational measures to ensure that none of the data is distributed to a third party.
