11. ELECTIONS

Subsequent to the four-years term of office, for which the Chamber of Deputies was elected on 14-15 June 2002, a regular election for the Chamber of Deputies, declared by the President of the CR in President’s Decision No. 31/2006 Coll. on 30 January 2006, was held on 2-3 June 2006. The whole course of elections as far as the distribution of seats were laid down by Act No. 247/1995 Coll., on the CR’s Parliamentary Election and on changes and completions of some other Acts, as amended.

The election for the Chamber of Deputies of the Parliament of the CR was held on the basis of universal, equal and direct suffrage by secret ballot, following the principle of proportional representation in the constituencies, which were higher territorial self-governing units determined by a special legislation and which corresponded with administrative regions of the Czech Republic. For voting for the Chamber of Deputies of the Parliament of the CR outside the Czech republic, special electoral wards were established in diplomatic and consular authorities, with the exception of consular authorities lead by honorary consular officers. Results from abroad were included in the results of the Jihočeský election region, as decided by lot draw by the State Election Committee. According to the Constitution of the CR there were 200 deputies elected for the period of four years.

The voters were Czech nationals aged 18 or more at least on the second day of the election who had no legal impediment to exercising their suffrage. They could cast their votes on any of the polling stations in the Czech Republic or abroad, where their names were recorded on the list of voters.

A total of 26 political parties, political movements and coalitions contested the seats. Their full names are stated in the table 11-3. Only registered political parties, political movements, whose activity was not suspended and their coalitions could submit the list of candidates for the election for the Chamber of Deputies. Each political party, political movement and coalition could submit only one candidate list in each election region. If a political party or a political movement submitted a separate candidate list they could not be a part of a coalition any more. The candidate could be stated only on one candidate list and in order preferred by the political party for allocation of seats. The maximum number of candidates was limited by the Act, differently for each election region. After the registration, the lists of candidates were printed to have the form of a ballot, independently for each political party, political movement and coalition.

Each voter voted independently, proxy was not permissible. To cast his/her vote, the voter put one of the ballots for the chosen political party, political movement or coalition into official envelope. At the same time the voter was allowed to show his/her preference for two candidates by encircling one or two ordinal numbers on the ballot of the selected political party, political movement or coalition. The voter was allowed to ask the local authority, for serious mainly health reasons, and during the elections the ward election committee to be able to vote outside of the polling station, only in the territory of the electoral ward. In that case the vote was carried out by putting the selected ballot into a portable ballot box, which was brought by two members of the ward election committee.

The number of valid votes for each political party, political movement and coalition decided on which of them will share the fixed number of seats. Those political parties, which reached the pre-fixed percentage of the total number of valid votes for the CR qualified for the scrutiny. The percentage was fixed by the Act differently, depending on the type of the list of candidates: 5% for a single political party and 10-20% for coalitions (according to the number of their members).

Seats falling on the election regions were allocated to the political parties, political movements and coalitions within the election region gradually with regard to the shares of votes calculated using the d’Hondt election divisor. The seats for the political party, political movement and coalition were obtained by its candidates in order, in which they were listed on the ballot, unless voters decided by their preferential votes otherwise. Candidates who did not obtain seats became substitutes.
